Terms of Use
Snap may change these terms at any time, and any changes will apply to any use of SnapShot after the new terms have been published here.
Your use of SnapShot
You may use SnapShot in accordance with the instructions provided. You agree not use it in any other way. You agree not to attempt to avoid or circumvent any of its features or to allow anyone else to use it. You agree not to incorporate a SnapShot poll in any website without the relevant permissions, or in a website that is unlawful in the UK or in the country where it is hosted.
Snap may remove any SnapShot poll and/or withdraw the SnapShot service at any time without giving any reason.
You do not acquire any rights to, or in, any aspect of SnapShot. You agree not to represent it as your own service or technology.
Snap does not acquire any rights to, or in, any data you collect through SnapShot.
If you choose to incorporate a third party's SnapShot poll in your website, all rights in and to any data collected through that poll belong to that third party and you do not acquire any rights to, or in, that data, or any licence to use it in any way.
Limited warranty and liability
In developing SnapShot, Snap has not knowingly infringed any third party's legal rights. But Snap is making SnapShot available to you free of charge, so it does not give any other assurance at all, and any assurance that would otherwise be implied is excluded. In particular, Snap does not give any assurance that SnapShot will be available, is free of errors or defects, or will function properly or reliably. SnapShot is made available to you 'as is'.
Snap has no liability for any of the following:
- problems with SnapShot's functionality, quality or availability
- exercising its rights under these terms
- claims brought by a third party, except to the extent it relates to the proven wilful infringement by Snap of the third party's copyright and you have notified Snap promptly and allowed it to deal with the claim
- loss or damage which does not arise directly and in the ordinary course of events
- loss of revenue, profit, savings, reputation or goodwill
- loss or corruption of any computer program, material, information or data.
Snap's total aggregate liability for all loss, damage, expenses and costs (including legal costs) in connection with SnapShot is limited to £100.
The exclusions and restrictions of Snap's assurances, obligations and liabilities in these terms cover all assurances, obligations, liabilities, loss and damage of the kind described however they arise, even if they result from Snap's negligence or from negligence for which Snap would otherwise be liable. As special exceptions, Snap does not exclude or restrict any liability it would otherwise have for any fraud or personal injury resulting from negligence.
General
These terms and your use of SnapShot are subject to English law. Any issue concerning or arising out of SnapShot, your use of it, or these terms is to be decided by the English courts.
Interpretation
'Snap': Snap Surveys Limited, a company registered in England under company number 01672722.
'SnapShot': The SnapShot Poll service run by Snap.
'assurance': any condition, warranty or other term, whether stated or implied for any reason (such as by any rule of law, the nature of SnapShot, or any previous transactions you may have had with Snap).
'you': means the individual, company or other organisation who has accepted these terms.
An obligation not to do something includes an obligation not to authorise or permit anyone to do it.
The use of the term 'including', or of particular examples, does not in any way limit the scope of any more general terms, which are to be given their widest meaning.
